LANSING – State Representative George Cushingberry Jr. (D-Detroit) announced he is cosponsoring a plan to allow consumers to sue credit reporting agencies for inaccurate or incomplete information filed on the consumer's credit record.
"When a reporting agency makes a mistake, it can cost a person money and time they can't get back," Cushingberry said. "And that to me is unacceptable. This plan will hold reporting agencies accountable for their mistakes."
The plan establishes the procedures for civil action against a consumer reporting agency that files inaccurate or incomplete information in a consumer's record. Under the plan, the district court has the jurisdiction to award any damages to the consumer under the Fair Credit Reporting Act, a federal law that regulates the collection, dissemination and use of consumer credit information.
"My plan will ensure consumer reporting agencies take extra precaution before filing any paperwork," Cushingberry said. "Too many of our residents have been affected by the carelessness of some consumer reporting agencies. By giving our residents the tools to defend themselves, we will cut down on the small mistakes that have a big effect on the lives of our residents."
